1. Acceptance
By accessing or using AgentAML, you agree to these Terms of Service. If you are using AgentAML on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Service description
AgentAML provides a software platform to assist Australian real estate agencies with AML/CTF compliance obligations. The platform is a tool to support compliance processes — it does not constitute legal advice and does not guarantee regulatory compliance.
3. Compliance responsibility
You remain solely responsible for your agency's compliance with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 and all associated Rules. AgentAML is a tool to assist that process. You must ensure all data entered is accurate and all decisions are reviewed by a qualified compliance officer.
4. AI-generated content
Any AI-generated content (including risk summaries) is provided as a draft only. All AI outputs must be reviewed and confirmed by an authorised compliance officer before use in compliance decisions. AgentAML is not liable for decisions made based on unreviewed AI output.
5. Data ownership
You own all compliance data you enter into AgentAML. We are a data processor acting on your instructions. You are responsible for ensuring data entered is accurate, lawfully obtained, and handled in accordance with privacy obligations.
6. Permitted use
You may use AgentAML only for lawful compliance purposes. You must not attempt to reverse engineer the platform, share access credentials, or use the platform to process data for organisations other than your own.
7. Subscription and payment
Subscriptions are billed monthly. Accounts with overdue payments may be suspended. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months.
8. Limitation of liability
AgentAML's liability is limited to the fees paid in the 3 months preceding the claim. We are not liable for indirect, consequential, or regulatory losses. These terms do not affect statutory rights that cannot be excluded under Australian Consumer Law.
9. Governing law
These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria.
